Boat travel and surfing voluntary release, waiver and assumption of risk
 

I hereby declare that I am going out with Momi Surf boat and I thoroughly understand and accept the hazard of surfing on the coral reefs including those hazards occurring during boat travel to and from surfing sites. I understand these hazards include, but are not limited to, injuries, drowning, sickness, slipping or falling while on board, being cut, by coral reefs or struck by a boat while in water. Injuries occurring while getting on or off the boat and other perils of the sea.

By signing this release, I certify that I am fully aware of and expressly assume these and all other risks involved in making such surfing or water sports adventures purely for my personal enjoyment.

I understand and agree that neither Momi Surf nor any employee of Momi Surf or the owners, crew may be held responsible in any way for any occurrence on this surfing trip which may result in personal injury, property damage, wrongful death or any damage to me or my family heirs or assigns that may result of my participation in this boat trip including snorkeling, fishing or any other water sports or pleasure cruises.

I understand that surfing, fishing, snorkeling and all other water sports may be physically strenuous and I expressly assume all risks in such activities. I acknowledge that it is up to me to have a travel insurance that would cover myself in case of injury.

I will not surf or participate in any water activities under the influence of alcohol or drugs and any medication taken is solely my responsibility. I have inspected all equipment that I am to use and acknowledge that it is in good working condition. I understand that even while using well maintained rental equipment there is a slight risk of malfunction and assume all risks.

I understand that surfing in open water on reefs involves certain risks, embolisms, motion sickness, heartache, etc and are often conducted in remote locations and I expressly assume all such risks. I will bear costs of any medical treatment, salvage and transport and authorise the base management to anything they think necessary in the vent that I am unable to make a decision and I will beat the cost resulting from it.

By signing, I hereby exempt and release all the above listed entities and/or individuals from all liability and responsibility for personal injury. Property damage or wrongful death, however caused, including but not limited to product liability or the negligence of the released parties, wether passive or active.

I acknowledge that I have read the forgoing paragraphs, fully understand the potential dangers incidental to engaging in this boat trip including surfing and all other water sports. I am fully aware of the legal consequences of signing this instrument and I understand and agree that this document is legally binding and will preclude me from recovering monetary damages from the above listed entities and/or individuals, wether specifically named or not, for personal injury, property damage or wrongful death by product liability or the negligence of the released parties, wether passive or active.
